March 11
9:00 am at Orem Justice Court, 97 East Center Street, Orem, Utah
Leave the school at 8:00 a.m
Be back at the school at 12:30. (The trial went longer than anticipated, so we got back later.)
Once again, I'm so proud of our team. They did a great job. This time we did not win by points, though it was close. The judges selected Derrick Cain as best attorney and Rebecca Geertsen as best witness. And we won the case. All charges were dismissed against our defendant Cris Robertson (Parker Shelby). Thank goodness!
I'd also like to compliment our team for their hard work, team spirit, great sportsmanship, civility, desire to learn and improve, and enthusiasm.
This time our attorneys were
Alex Pearrow
Joseph Steed
Derrick Cain
Tony Jeffs
The students who played witnesses were
Parker Shelby
Annika Shunn
Rebecca Geertsen
Our bailiff was
Kenlee Woolstenhulme
And our alternate for this trial was
Sarah Ellison
We would like to thank our team members who were at the band festival yesterday, but had helped us build our case and prepare for this trial:
Erykah Cain
Cristine Busto
Monica Lish

Kenlee: Bailiff
Annika: Cris Robertson
Parker: Loren Albert
Sarah: Pat Clifford
Becca -- Witness Understudy
Questions to be answered for our telling of the case:
Why did Cris use the quotation marks around jam and jammin?
Why did Cris talk about blood showing up on the dark colors?
CHS hoodie "nasty"?
Points to make -
rumor: doubt about where it originated --- Don't bring it up unless prosecution does.
In Exhibit A, MichaelGForce Doesn't know who jammin is
Yankeegirl doesn't know
We may need to switch around our witnesses. Sarah, are you going to participate? Loren and Annika, would you be willing to switch?
Annika: Cris
Loren: Parker
Becca: Pat
Suggestions, Notes after our first trial:
Make sure evidence has been admitted before we use it -- or we need to move to admit it ourselves.
Check on whether we need to introduce any evidence as defense.
Now Cris is totally innocent. Cris is the victim of false accusations, of a prank, or worse, committed by someone who is using Cris's chat room accounts.
Can we show that Cris was not aware of these misuses?
How could someone get Cris's accounts?
Can we know for sure who sent those messages?
Why does he or she use both accounts?
How do we explain the quotation marks around "jammin"?
Loren:
Pat: is not a high school student, but spends every weekday with high school students, so has an understanding of them and the way they talk that many people don't
very common for one student to use another's password -- There is no way to determine who is using a user name and password. Alibi -- working with Cris during FatalFlaw transmissions on October 15. So we know that someone else had the password for FatalFlaw.
Loren:author of usage policy -- so understands(better than most people) the law concerning cyber harassement (consulted with Ashton Hopp?)
Pat and Loren both know how computers and chatrooms work. though neither an expert on cyber crime, they have some knowledge and both are experts on how computer, user names, passwords, and chatrooms work.
Exhibit A
nasty:according to dictionary.com
Slang . formidable: The young pitcher has a good fast ball and a nasty curve.
or that they all (THE CHS hoodie) just get really dirty after wearing them for a whole week all the time.
MichaelG doesn't know who Jammin is -- would know if on the football team -- Both he and yankeegirl are following the football team and would know who is on it.
Yankeegirl in Exhibit A doesn't know if Jammin is a girl or boy? (if their Jamie is a girl)
Exhibit B -- FatalFlaw may not even have read Jamimin's response, so wouldn't have cause to be mad. -- may have already getting ready to exit when Jammin's response came up.
Exhibit C --cannonball is talking about STOMPING all over the other team
after that shokwave (Cris admits) responds to Cannonball's comment. Cris emphasizes "Jam" because it is like stomp?
How do we explain, "Aware of FatalFlaw, not interested" ?
Cris 4:51 -- Would it make sense that Cris could have left the computer (Would Cris have been at school that late? -- Thursday) No activity -- not even any logging out.
Working in library on the same research paper that had worked later with Pat? 20 minute lapse. . .
Cris denies
Exhibit D -- denies all transmissions -- working with Pat.
We're here to clarify that . . . .
Questions for
Pat
Loren
Cris -- Our team is so tough. I was excited
may have just automatically logged in as Shokwav -- so used to it.
Wouldn't be upset by chat room correction because it was just one page difference in the assignment.
Ashton
Casey
Casey do you know without a doubt that Cris Robertson was trying to hurt Jamie Anderson?
Do you know without a doubt that it was Cris Robertson who sent all of those messages on the chat room?
Jamie
rumor
Exhibit A -- why use "jammin" in this statement
Cris praising Jamie for school spirit
eking
Everyone needs to read the Opening Statement. This is our story, and all witness examinations need to support it. We need to make sure our questions prove the points Joseph bring up.

New Pages:
Introducing Physical Evidence
Objections
Questions, comments for this case:
Do we need to identify the defendant?
Cris has already spread rumors -- verbally -- offline -- before the online harassment began.
Is 'harassment" the word we should focus on?
From which witness should we show that all of the harmful comments came from accounts belonging to Cris?
We need to really emphasize the quotation marks.
Questions about the case: Anyone can help answer these:
Were the students required to attend the assembly?
What we need to work on -- especially --
expert witnesses

Notes:
We will demonstrate that Cris Robertson had the intent to annoy, alarm, intimidate, offend, abuse, threaten, harass, and frighten Jamie Anderson.
We will show that Cris Robertson had motivation to harm or harass Jamie Anderson, and had already attempted harm to Jamie offline.
We will show that Cris Robertson (the defendant) made repeated contact by means of electronic communication through a school chat room,
having signed a usage statement promising that he/she would not use defamatory, threatening, or abusive language while participating in the school chat room.
We will provide transcripts from the Clearwater High School chatroom where the defendant insulted and taunted Jamie Anderson and threatened injury and physical harm.
Cris Robertson will admit that he/she was using both usernames behind the alarming messages.
The investigating officer, a man with much experience in dealing with cyber crime, will testify to the proof found in his investigation that Cris Robertson committed this cyber crime against Jamie Anderson, and will testify as to the state in which Jamie came to him to report this crime.
A close friend of Jamie Anderson, Casey Wallner, who also knows Cris Robertson, and who was present in the chat room during the times that Cris Robertson harassed Jamie, will testify about the insulting and frightening communications that came from Cris Robertson. We will introduce into evidence her planner notes, taken at those times, noting instances of Cris Robertson's attacks on her friend Jamie.
Casey Wallner and Jamie Anderson will testify that the nickname by which Cris Robertson referred to her in his/her threatening messages was a name by which she had been known at their school for years.
Need to get from
Ashton
an expert witness --
introduce transcripts into evidence
origin of the transcripts
how many posts were threatening, insulting,
Casey
Ask her what her username is.
Ask her about the planner notes -- introduce into evidence
After asking about how Jamie got her nickname.
What did it mean to you when you saw "Jam" and "Jammin" in quotation marks? answer: It was clearly referring to Jamie October 8, October 14

As the bailiff " I swear to tell the truth, the whole truth, and nothing but the truth, unless I forget the truth and then I will make it up." Just kidding because I won't be saying much.
